CANCELLATION AND REFUND POLICY
Overview and Acceptance
This Cancellation and Refund Policy outlines the terms governing the cancellation of services and the conditions under which refunds may be issued by Arctic Nodes. By utilizing our cloud hosting services and making payments, you acknowledge and agree to abide by this comprehensive policy. This policy is designed to be compliant with standard Indian financial regulations and operational guidelines, particularly concerning transactions processed through our primary payment gateway, Razorpay.
Service Provisioning and Cancellation
Cancellation Prior to Provisioning
You may cancel your service order and request a full refund only if the service (e.g., Virtual Machine, storage instance, or other resource) has not yet been provisioned and made available for your use.
Post-Provisioning Policy
Once a service has been provisioned, activated, and access details have been delivered, the corresponding payment is considered final and non-refundable.
Refund Eligibility
Valid Refund Grounds (Duplicate or Failed Transactions Only)
Refunds will only be processed for payments that are demonstrably duplicate transactions or instances of a payment failing to complete successfully yet still resulting in a debit from the user's account. All such claims must be validated and confirmed by our payment gateway, Razorpay.
Exclusions (Non-Refundable Fees)
Under all circumstances, the following charges are strictly non-refundable:
- Payment gateway processing fees.
- Platform-level transaction processing fees.
- Goods and Services Tax (GST) or any other applicable statutory taxes/levies, as these are remitted to the relevant government authorities.
Net Amount Processing
Any approved refund amount will be calculated and processed on the net service cost only, after deducting all applicable taxes, GST, and non-refundable payment gateway/platform processing fees.
No Partial or Pro-Rata Refunds
Arctic Nodes does not offer partial, pro-rata, or time-based refunds for any unused service duration, regardless of the reason for service discontinuation (e.g., early termination, voluntary cancellation, or policy violation).
Payment Disputes and Service Disruption
Disputed Transactions and Suspension
Initiating a dispute with your bank or financial institution (e.g., filing a chargeback or initiating an investigation) regarding any payment automatically and immediately triggers the suspension of all services linked to that specific payment. This action is irreversible pending the resolution of the dispute.
Chargebacks and Permanent Termination
If a payment dispute or chargeback is successfully executed against Arctic Nodes, it will result in the immediate and permanent termination of the associated service(s). Furthermore, this action may lead to a permanent ban or restriction on the related user account to prevent future financial risk.
Account Liability, Abuse, and Vitiation of Refund Rights
Abuse, Fraud, and Policy Violations
Accounts flagged, suspended, or permanently banned for engaging in illegal activity, fraud, the distribution of malware, denial-of-service (DDoS) attacks, unauthorized or illegal scripts, or any other violation of the Arctic Nodes Acceptable Use Policy cannot use cancellation or refund requests as a means to erase liability for past usage or account breach.
Automatic Denial of Refund Requests
A refund request will be automatically and unconditionally denied if the associated account or payment instrument is found to have any of the following:
- An active abuse flag or documented policy violation.
- A confirmed fraud signal.
- An open payment dispute or chargeback.
- Any ongoing security or fraud investigation.
Invalid Grounds for Refund Claims
The following circumstances are explicitly not considered valid grounds for a refund and will result in denial:
- Claims related to "forgotten" payment or renewal dates.
- Failure to renew services, resulting in expiration.
- Voluntary self-deletion or termination of resources by the user.
- Claims of not being aware of the renewal timing or service terms.
Illegal Activity Voids All Rights
Any instance where Arctic Nodes resources are utilized for illegal activities, cyber-attacks, distribution of malware, operation of botnets, copyright infringement, or the use of unverified or fraudulent payment instruments will immediately void all existing and future refund rights associated with that account.
Service Discontinuation (Non-Renewal)
Failure to timely renew a service or a delayed renewal payment will be unequivocally treated as a voluntary discontinuation of the service by the user. In such cases, Arctic Nodes bears no liability for any subsequent data loss, instance deletion, or unavailability of the service resources.
